Leavittsburg, Ohio 44430-0901 Justice Center, Courts Tower 1200 Ontario Street Cleveland, Ohio 44113 2 SWEENEY, C.J.: On May 19, 1997, the relator, Kelvin Thompson, commenced this mandamus action to compel the respondent, Judge Timothy McGinty, to issue findings of fact and conclusions of law for a postconviction petition filed in the underlying case, State of Ohio v. Kelvin Thompson, Cuyahoga County Common Pleas Court Case No. Cr. 303894 in August 1996. Judge McGinty, through the Cuyahoga County Prosecutor, has established that the request for mandamus is moot. Attached to the respondent's motion for summary judgment is a copy of the respondent's findings of fact and conclusions of law, journalized May 23, 1997, which denies the petition for postconviction relief. State ex rel. Carrion v. Harris (1988), 40 Ohio St.3d 19, 530 N.E.2d 1330. Mr. Thompson has not filed any opposition to this motion. Accordingly, the respondent's motion for summary judgment is granted, and this writ action is dismissed. Respondent to pay costs. BLACKMON, J., CONCURS. .
