The respondent has filed a motion to dismiss which this court shall treat as a motion for summary judgment per Civ.R. 12(B). For the following reasons we grant the respondent's motion for summary judgment. Attached to the respondent's motion for summary judgment is an affidavit which establishes that the relator has received all public records as requested. Thus, the relator's request for a writ of mandamus has been rendered moot. State ex rel. Snider v. Stapleton (1992), 65 Ohio St.3d 40; State ex rel. Richard v. Wells (1992), 64 Ohio St.3d 76.
