J.:
     Relator requests that  this court  compel respondent judge  to
issue findings of fact  and conclusions of law with respect  to the
petition for postconviction  relief which relator asserts  he filed
in State v. Sidney,  Cuyahoga County Court of Common Pleas Case No.
CR-330782.
     Relator asserted the  same claim  in State ex  rel. Sidney  v.
Tubbs Jones (Mar.  6, 1997), Cuyahoga  App. No. 71940,  unreported.
This court dismissed Case No. 71940 because the docket  in Case No.
CR-330782 does not reflect that relator  filed a petition for post-
conviction relief.  As a consequence, this action is duplicative of
Case No. 71940 and is dismissed.
     Furthermore,  relator  failed  to  comply  with Loc.  App.  R.
8(B)(1)  which  requires that  complaints  in original  actions "be
supported  by an affidavit from the plaintiff or relator specifying
the details of the claim."
     Accordingly, this action is dismissed sua sponte.  Relator  to
pay costs.
     Writ dismissed.
