In In the Matter of: Zhang, Cuyahoga County Court of Common Pleas, Juvenile Division, Case No. 9411811, juvenile court placed Rhonda Lan Zhang ("Rhonda")--who was born in Cleveland, Ohio on November 3, 1993--in the foster care of petitioner Laura Kingsley Hong in March 1995. See Petition, Exhibit A. Petitioner Hong avers that respondent Sue Ping Chen--Rhonda's natural mother-- abducted Rhonda to China on or about October 15, 1996. "A Court of Appeals has jurisdiction to entertain a petition for a writ of habeas corpus involving the custody of a child." In re Black (1973), 36 Ohio St.2d 124, 304 N.E.2d 394, paragraph three of the syllabus. We find that the petition states a claim in habeas corpus and that, pursuant to R.C. 2725.06, we must grant the writ of habeas corpus. Petitioner Hong or her designee shall serve copies of the summons and complaint as well as a copy of this order on respondent Chen and file a return of service with the clerk of this court. Petitioner Hong shall notify this court in writing when service has been effected. Accordingly, the writ of habeas corpus is issued and respondent Sue Ping Chen is commanded to bring Rhonda Lan Zhang before this court within seven days of service upon respondent Chen - 3 - of copies of the summons and complaint as well as a copy of this order for a hearing on the merits which will be scheduled upon receipt of the return of service.
