   KRUPANSKY, J.:

        Hearing  for  oral argument  on  the within  matter  set for

   October 27,  1992.  On  October 26, 1992  counsel filed with  the

   court information that  this case had been  settled and dismissed

   by the parties.  The notice, captioned "Stipulation for Dismissal

   and Judgment Entry," reads as follows:

                We,  the  attorneys  for   the  respective
             parties, do hereby  stipulate that the above-
             captioned  lawsuit  has   been  settled   and
             dismissed,  with  prejudice  at Appellant[']s
             cost herein and  that the Court may  enter an
             order accordingly, notice by  the Clerk being
             hereby waived.

   The  above  "stipulation  for dismissal  and  judgment  entry" is

   signed by counsel for both parties.

        The  court  therefore  enters  the  order requested  by  the

   attorneys for the parties, viz.:

             Appeal    dismissed    with    prejudice   at
             appellant's costs.
