Says who?

If it was Gene - he's dead, so it doesn't matter what he thinks is canon.

And bits from TAS have popped up on the shows from time to time, such 
as Kor's old ship (the Klothos) from TAS, being mentioned on a DS9 ep. 
So for me at least, that makes TAS canon.
