A locomotive has every right to travel from point A to point B without giving
consideration to any person that is obstructing the tracks, because
the tracks are the property of the railroad.
Charges are never brought against the engineer when a person is killed by
a train because that person is a trespasser and has no business there.

It is to the credit of the engineer that he makes a concerted effort to stop
the train before he hits the person, rather than just traveling on without
applying the brakes and excusing himself later by saying, "We have every
right..."
