Yes this is by design, in dos when you issuse a del command it is deleted and dosn't go to the recylcle bin. However there used to be a command to undelete files but I dont think it was ever included in "windows dos" Of course if you knew where the recycle bin directory (if there a vaild dos one) you could always write a batch file to move the files there rather than delete them. FYI other ways files will not get put in the recylcle bin are 1) Network drive 2) Hold down shift key before deleting file. One more thing I am sure there is a registry setting (cant rember where) that switchs off the recycle bin permently.
