Unless something has changed, the trademark is held by the Open Systems 
Foundation, not by any particular vendor/manufacturer.

OSF established a set of criteria that must be met in order for a product to 
carry the name "Unix". I believe there's also a hefty licensing fee involved.

One of those two reasons is why SCO changed their product name from "SCO Unix" 
to "SCO OpenServer".
