   A lot of ASCII art gets passed around and modified.  While it is 
technically copyrighted, most artists don't care if you pass their pics 
around as long as you leave their credit on the piece.

   If you are going to use a pic for commercial purposes, than you should 
contact the artist and get permission, pay for it, etc.

   As to modifying art, some of us don't mind that as long as you make it 
clear who the artists involved are.
